Terms of Service — DAB Bot

1. Who we are

DAB Bot is provided by DAB Bot (Bjorn), Belgium ("we"). Contact: support@dabbot.eu. We reply in Dutch or English.

2. Acceptance

By adding DAB Bot to a Discord server, logging into Studio or the desktop app, or buying something, you agree to these terms and our privacy policy. If you don't agree, don't use the service.

3. Age

You must be at least 13 (or the minimum age Discord requires in your country) and follow the Discord Terms. Buying a package or Market pack requires being 18, or younger with the permission of a parent or guardian.

4. The service

DAB Bot is a Discord bot with a web dashboard (Studio), a desktop app and OBS overlays: moderation, leveling, economy, tickets, automations, games, tournaments, live alerts and integrations with Twitch, YouTube, Kick and Spotify, and more. Features may be added, changed or removed. If a paid feature you bought stops working, we offer an equivalent solution or refund the remaining part.

5. Account and access

• You log in with your own Discord account. You are responsible for what happens through your account.
• Only members with the Discord "Manage Server" permission can configure a server.
• Only connect streaming accounts that are yours or that you have permission for.

6. Packages and payments

• There is a free version and paid packages (Community, Streamer, All-in-one), per server. You see the price and what's included on the billing page before you pay. Prices are in euro and include VAT where applicable.
• Monthly and yearly plans are subscriptions that renew automatically until you cancel. You can cancel anytime in Studio (billing); you keep access until the end of the paid period.
• Lifetime is a one-time payment for that package on that server, for as long as DAB Bot exists. If we stop the service within 3 years of your purchase, we refund a proportional part.
• Market packs are official overlays you buy once for a server. Users can only share for free on the Market, not sell.
• Payment goes through Stripe or PayPal. You get a receipt or invoice as a Discord DM.
• Price changes only apply from your next renewal and are announced at least 30 days in advance; you can cancel before they take effect.

7. Right of withdrawal and refunds

As a consumer in the EU you have 14 days to withdraw from a new purchase without giving a reason. This applies to every new purchase (also on another server), but not to an automatic renewal of an existing subscription.

• How: with the "Withdraw purchase" button on the billing page in Studio, or by emailing support@dabbot.eu with your server and the purchase date. You get a confirmation.
• What you get back: we refund within 14 days through the same payment method. If you asked at purchase for the package to start right away, we deduct the part you already used (per day of the monthly price; for Lifetime we charge the monthly price per started month). So someone who uses it for 13 days and withdraws pays for those 13 days.
• Market packs are digital content. If at purchase you asked for immediate delivery and acknowledged that you lose your right of withdrawal, that right ends once the pack is installed.
• After those 14 days we don't refund, unless the law requires it or a paid feature was out of order for a long time through our fault.
• In case of abuse, such as repeatedly buying and withdrawing to use paid features for free, we may refuse new purchases. Your statutory rights always apply.

You can also use this model form: "To DAB Bot (Bjorn), <email>: I hereby withdraw from my contract for <package> on server <server name>, bought on <date>. Name, Discord name, date."

8. Acceptable use

You may not use DAB Bot to:

• break the terms or guidelines of Discord, Twitch, YouTube, Kick or Spotify, or the law;
• harass, threaten or harm others, or spread illegal content;
• overload, abuse or scrape the service, or bypass its security;
• resell or rehost the bot, Studio or overlays without our written permission.

9. Your content

What you create or upload (commands, messages, images, sounds, overlays) stays yours. You only give us the right to store and show it as far as needed to provide the service. If you share something for free on the Market, other servers may use and adapt it for their own stream or server. You confirm you have the right to use and share what you upload, and you are responsible for that content.

10. Moderation and reporting illegal content

• Point of contact for users and authorities (Digital Services Act): support@dabbot.eu, in Dutch or English.
• If you see content on DAB Bot that is illegal or breaks these terms (e.g. an overlay, upload or Market item), report it through the report page or by email. Include the link, why it is illegal, and optionally your name and email.
• We review every report carefully and without undue delay, and tell you what we decided. Decisions are made by a person, not an automated system.
• If we remove or hide your content, or restrict your account, you get the reason. You can object at support@dabbot.eu; we will then review it again.
• We may suspend access for repeated or serious violations, and for repeated reports that are clearly unfounded.
• Moderation inside a Discord server (automod, warnings, bans) is set up by the server owner; we are not a party to it.

11. AI features

/support and the AI helper in Studio give answers generated by AI, and say so. Those answers can be wrong: check important information and don't rely on it blindly. Don't enter sensitive personal data.

12. Third-party services

DAB Bot works with Discord, Twitch, YouTube, Kick, TikTok, Spotify, Stripe and PayPal. Their own terms apply to their services. If they change something or go down, a feature may stop working temporarily or permanently; that is outside our control.

13. Availability

We do our best to keep the service online, but don't guarantee uninterrupted operation. We announce maintenance in advance where possible.

14. Warranty and liability

• As a consumer you have the statutory rights for digital services; these terms don't limit them.
• Otherwise we are not liable for indirect damage, such as loss of data, revenue or followers, and our liability is limited to what you paid us in the 12 months before the problem.
• This limitation doesn't apply to intent, gross negligence, or harm to life or health.

15. Ending

You can stop anytime by removing the bot from your server and cancelling your subscription. We may end access for a serious or repeated breach of these terms; you get the reason. If we stop the service entirely, we announce it at least 30 days in advance and refund paid periods that weren't used yet.

16. Server member data

As a server owner you are responsible for the member data you have the bot process; we process it on your behalf under the data processing agreement, which is part of these terms.

17. Governing law and disputes

These terms are governed by Belgian law. If you are a consumer in another EU country, you keep the mandatory protection of your own country's law and can also go to court there. If there is a problem, contact us first at support@dabbot.eu; we'll look for a solution together. If that fails, you can turn to the Belgian Consumer Ombudsman Service.

18. Changes

We may update these terms when the service changes. We announce significant changes at least 30 days in advance in Studio. If you don't agree, you can cancel before they take effect.
